American Dream Vacations - Oklahoma Rental Terms for travel between 01-Jan-2008 and 31-Dec-2009

1.) The relationship between the parties to this contract is that of Lessor and Lessee, and Lessee is not, and shall not hold himself out to be, an agent or employee of Lessor, or in any capacity other than Lessee. Lessee shall have no authority to represent or make commitment binding upon Lessor. Lessee may not assign or sublet the Motor Home.

2.) Lessee acknowledges that he has carefully examined the Motor Home and all additional equipment and furnishings and acknowledges receipt of same in good condition. Lessee agrees to pay Lessor the value of any equipment and furnishings which are lost, stolen, destroyed or damaged during the term of this contract.

3.) Lessee agrees to maintain the Motor Home in strict compliance with the manufacturer's suggested maintenance procedures and in accordance with Lessor's instructions given to Lessee, and to periodically examine the Motor Home’s operating components essential to its operation, including but not limited to tires, batteries, radiator water, transmission and all other fluid levels. Flat tires are the responsibility of Lessee. ALL blown out tires MUST be returned to Lessor and CANNOT be left with any service shop or roadside assistance technician.

4.) Normal maintenance and road repairs, including necessary oil and lubrication expenses, are provided by Lessor. Lessor will not be liable for repairs or any damages resulting to Lessee caused by the need for repairs unless written proof that said expenditures were incurred is received, along with return of the parts which were replaced. Failure to return replaced parts, including blown tires, will result in the Lessee being responsible for all charges relating to the breakdown. Lessee agrees to contact Lessor by telephone at Lessor’s expense if any repairs to the Motor Home in excess of $50.00 are required. Lessee agrees to obtain Lessor's specific approval for the repair and understands it must be done at an authorized agency approved by Lessor and to keep record of same. Any such authorization given shall not constitute a waiver of Lessor's right to charge Lessee for such repairs if, in the opinion of Lessor, such repairs were due to negligence, misuse or carelessness of Lessee.

5.) TOWABLES: Lessee shall indemnify and hold harmless Lessor from any and all claims, costs and damages to the rental vehicle and related equipment, including any loss of use by Lessor of the vehicle, arising from the operation, maintenance and use of the vehicle during the term of this lease. Lessee represents to Lessor that Lessee shall provide, at Lessee’s expense, compulsory liability insurance covering the tow vehicle and rental trailer, and that Lessee shall indemnify and hold harmless Lessor from any and all third party claims arising from the operation maintenance and use of the rental trailer during the term of this lease, and by Lessee’s initials does hereby acknowledge that Lessor does not provide any liability insurance covering the rental trailer or Lessee’s operation, maintenance and use of same. Lessee understands that units equipped with canvas may be subject to leaks when subjected to rain and no refunds will be given in the event of a water leak.

6.) MOTORHOMES: All overhead damages caused to the Motorhome due to its misuse or Lessee’s negligence or carelessness, whether overhead damage, damage to tires and wheels, damage to step or undercarriage of vehicle, interior and exterior damage, windshield & glass damage or other damage of whatever kind or character are the responsibility of the Lessee. Only damage resulting from a collision with another vehicle shall be covered by Lessor’s insurance carrier. Lessor assumes no responsibility for any equipment belonging to Lessee.

7.) In the event of a breakdown, wherein the Motor Home is inoperable for 24 hours or more, Lessor's responsibility shall be limited to reimbursement of rental rate for day(s) lost only. Lessor will not be liable for any other expenses or damages as a result of a breakdown. Failure of the drive train components ONLY will constitute a breakdown. Failure of any other RV components will not be considered for reimbursement. Both parties contract and agree that any legal remedy which either may elect to utilize shall be brought solely in Kendall County, Texas.

8.) Lessor will maintain liability insurance coverage on the Motor Home in the amounts of $20,000/$40,000/$15,000. Lessee shall be liable for the deductible amount for each accident. Lessee understands and agrees that the use of the motor home is confined to the continental United States and Canada. THIS MOTOR HOME CAN NOT BE TAKEN INTO MEXICO. Lessee agrees to hold Lessor harmless and indemnify and defend against any claims, demands or liabilities whatsoever in excess of such limits. In the event of an accident, Lessee will advise Lessor within 24 hours and submit a full written report within 72 hours.

9.) Lessor shall not be liable for any damage to property or injury to persons (including death) resulting through the use, operation or possession of the Motor Home and Lessee shall hold Lessor harmless from liabilities resulting from such damage or injury.

10.) Lessee agrees that the Motor Home shall be operated by a properly licensed driver and not by any person under the age of 25 or by any person while such person is under the influence of intoxicants or narcotics. Lessee agrees that the Motor Home will not be operated for any illegal purpose, over any rough terrain, on any coastal beach, to propel or tow any vehicle other than those pre-approved by Lessor, or in excess of the safe speed with regard to all conditions. Lessee will be responsible for all traffic violations and any costs incurred as a result of same.

11.) The number of miles over which the vehicle shall have been operated pursuant to this contract shall be determined by reading the mileage recording devices attached to the Motor Home, with which Lessee agrees not to disconnect or otherwise tamper. Any tampering with these devices shall entitle Lessor to set an arbitrary charge equal to 500 miles per day of use. Lessee agrees to pay Lessor $.29 per mile for any miles above those included with the rental.

12.) Lessee agrees to return the Motor Home in the same condition as when rented. Upon departure, fuel tanks are full and must be refilled. Holding tanks must be emptied to avoid a $30.00 charge and unit must be clean, inside and out, or a cleaning fee will be assessed. There are no refunds on Prepaid Cleaning or Dumping. To refill gas tanks, Lessee will be charged $5.00 per gallon plus a service fee of $25.00.

13.) If Lessee has insurance covering loss or damage, Lessee shall exercise all rights available to him under said insurance, take all action necessary to process said claim and further agree to assign said claim and any and all proceeds from insurance to Lessor.

14.) Lessee agrees that no credit or refund will be given if the Motor Home is returned prior to the expiration date of this contract and in such event, Lessee will still be required to pay all charges as if the Motor Home were returned at such expiration date.

15.) Lessee agrees to pay Lessor for any period during which the Motor Home is held beyond the expiration time on the basis of $25.00 per hour for each hour, or any portion of an hour, the unit is overdue. Lessee further agrees to pay, upon demand by Lessor, any rental fees lost to, or liabilities incurred by Lessor due to down time of unit during repair of collision damage caused by Lessee.

16.) In the event the Motor Home is not returned by Lessee to American Dream Vacations, 28840 IH 10 West, Boerne, TX. Lessee agrees to pay, upon Lessor's demand, in addition to all other sums payable and all other liabilities incurred under this contract, a full day's rental charge, plus $2.00 per mile until it's recovery and return. Lessee further understands that dropping off the Motor Home at the agent's location, other than during normal business hours, does not constitute a return and Lessee is responsible for said Motor Home until properly checked in by Lessor. WARNING: FAILURE TO PROMPTLY RETURN THE LEASED PROPERTY MAY RESULT IN A CRIMINAL PROSECUTION AS PROVIDED FOR UNDER CURRENT TEXAS LAW.

17.) In the event of a breach of any of the terms and provisions of the contract by Lessee, Lessor may, without prior demand, take possession of the Motor Home by entry upon Lessee's premises if necessary, with or without process of law. In the event of any breach, Lessee shall be liable for all expenses incurred by Lessor, including reasonable attorney's fees, court costs expended to enforce collection, interest on any outstanding balance at a rate of 18% or the maximum allowed by law and in addition, Lessee shall be liable for all damages suffered by Lessor as a result of such breach. It is understood and agreed that any legal remedy shall be sought in Kendall County, TX.

18.) Where as, in the event this contract is used for Travel Trailers and or Tent Campers, whenever the words Motor Home are mentioned, Travel Trailer or Tent Camper should be substituted.

19.) Pick up and return times are as follows: Pick up after 2:00 p.m. and return by 11:00 a.m. Any exceptions are as a courtesy only and are not an integral part of this contract. ALL exceptions must be approved at least 48 hours prior to the scheduled pick up or return.

Reservation deposit
Further to the Deposit Payable Upon Confirmation, American Dream Vacations will be taking a 2nd stage payment of US$300.00 for Motorhomes or US$200 for trailers.  Both the booking deposit and 2nd stage payment are taken from your total rental cost.  The remainder of your rental is to be paid upon the commencement of your rental directly to American Dream Vacation.  You initial booking deposit paid upon confirmation of your booking can be paid using Visa or Mastercard only.  The 2nd stage payment and final payment of the remainder of your rental can be paid using cash, checks, Visa, Mastercard, Discover and American Express.

Damage Deposit
There is a damage deposit of $500.00 ($1,000.00 for foreign nationals). This is taken in addition to your standard rental costs. This deposit will be taken at the commencement of your rental by American Dream Vacations. This can be in the form of cash, check, Visa, Mastercard or Discover. The damage deposit is refunded within 10 business days from when the unit is returned undamaged.  Any other additional costs incurred during your rental (e.g. additional miles ) can be taken from this deposit and the remainder paid to you if you wish as well.

Cancellation policy:
The initial deposit paid on booking confirmation is non-refundable. In addition to forfeiting your deposit, the following cancellation charges from American Dream Vacations also apply:
Cancellations from 33 to 93 days prior to departure forfeit an additional US$100.00, 
Cancellations less than 33 days from departure forfeit US$200. 

Travel insurance
We strongly recommend that clients ensure they take out the highest level of travel insurance. In many cases this will cover any losses incurred if you are forced to cancel your booking.

The unit of your choice with a minimum of the following equipment. Generator (Produces 110v electricity), dash and roof air conditioning, tilt steering wheel, am/fm stereo cassette deck, TV antenna with power booster, furnace, water heater, fresh water holding tank, waste water holding tanks, complete kitchen with sink, stove, microwave oven and 2 door refrigerator/freezer, complete bathroom facilities including shower, sink and toilet, clothes closets and beds according to floor plans. Class A motor homes (MH) have built in TV. Some Class C motor homes (MMH) are TV ready but do NOT have the TV in them.

Full tank of fuel, fresh water tank is full, a minimum of 1/2 tank of propane, waste water tanks are empty, 4 roll pack of RV toilet tissue, 2 bottles of toilet chemical, fresh water drinking hose, water pressure regulator, 10 ft. sewer hose and a 30amp/15amp electrical adapter.

Unit is cleaned inside and out, refrigerator is on and cold, water heater is lit, all systems have been checked for proper operation and the black water waste tank is charged with toilet chemical. All beds are disinfected after each use.

Insurance. The renter is responsible for the first $2,000.00 on collision damage. Check with your auto insurance company. Many of them will cover the rented RV under your auto policy. This responsibility can be reduced to $1,000.00 for $12.00 per rental day. (Optional)

Unlimited generator use. There is a mandatory flat fee of $5.00 per rental night for unlimited generator use. NO prep fees or hidden charges.

Rates are based on a 3 day minimum. (1 and 2 day rentals will be charged a surcharge but can be accommodated.) You will receive 100 miles per rental day. Rentals of 1 week or longer will receive 150 miles per rental day.

24 hour per day/7 days per week roadside assistance plus our own toll free 800 line for Customer Service.

Rental Unit Handbook that tells you in "plain" English how to operate the various systems on the RV.

Indoctrination Video Tape that is a "mirrored" image of your walk-through. We realize you'll forget much of what you're shown when you pick the unit up so we furnish you a walk-through on video tape. When you forget something, pop the tape in the VCR and fast forward to the area in question. Let an expert SHOW you how it's done!

Previous damage can be a problem for you if it's not detected during the walk-through process. We've taken every precaution to make certain we NEVER charge a renter for damage that was already there. In addition to the personal walk-through inspection with you, we take digital photos of the unit just before you leave. We are committed to making sure you're not charged for damage you didn't do.

Free mileage is, of course, never really free but we've got the most liberal "included" mileage in the industry. On Motorhome rentals of less than one week in duration, you get 100 miles per rental day included. On Motorhome rentals of one week or more, you get 150 miles per rental day. Additional miles are $0.29 per mile. Most companies charge between $.30 and $.40 per mile.
All Travel Trailers and Tent Trailers come with unlimited mileage - some companies will charge you for mileage on towable units, we at American Dream Vacations do not.

Taxes
Vehicles picked up from our Oklahoma City location will be subject to Oklahoma State Tax of 15.38%
Tax will be itemised in your breakdown of charges.

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.


American Dream Vacations - Oklahoma Insurance

Insurance. Insurance is included in the rental rates. The renter is responsible for the first $2,000.00 in the event of a collision with another vehicle or pay $12 per day to reduce the liability to US$1000. Please note: this optional insurance is only available for Motorhome rentals. Check with your auto insurance company. Many of them will cover the rented RV under your auto policy.
